SpendPlan Privacy Policy

INTRODUCTION. This Privacy Policy (the “Policy”) explains how Spendplan, Inc. (“SpendPlan”, “we”, “our”) collects, uses, and discloses personal information through its website and its online platform that assists companies in forecasting financial performance on discrete projects (the “Platform”, and collectively with the website, the “Services”). By using or accessing the Services in any manner, you acknowledge that you accept the practices and policies outlined in this Policy, and you hereby consent that we will collect, use, and share your personal information in the following ways.
AFFILIATION WITH CUSTOMER. Your use of the Platform is conditioned upon your affiliation with a customer of SpendPlan (the “Customer”). Your use of the Platform is subject to the terms of the agreement between SpendPlan and the Customer (the “Customer Agreement”). If you have any questions about the Customer Agreement, please submit your questions to the Customer.
INFORMATION COLLECTED AND HOW WE USE IT. As explained further in this section, you will have the opportunity to provide us with certain personal information. In addition, we may collect certain personal information from the Customer or automatically through your use of the Services. We will use this information to provide you, the Customer, and other users affiliated with the Customer (your “Coworkers”) with the functionality of our Services, to improve our Services, and to provide you with information about our Services. The rest of this section provides a more detailed explanation of the personal information we collect and how we use that personal information.
Personal Information that You Submit.
Account Creation. As part of the account creation process, you will choose a login password and you may have the option to upload a photo that will be associated with your account.
Requests for Information. If you are interested in learning more about our Services, you may submit your name and email address through our website in order to schedule a meeting with SpendPlan, submit questions, and sign up to receive promotional emails about our Platform. If you are not otherwise a user of our Platform, we will only use your personal information to answer your questions and schedule a meeting.
Personal Information that the Customer Submits.
The Customer may submit certain information about you in order to use the Platform and (if applicable) to set up an account for you to use on behalf of the Customer. Such information may include: (i) your name, (ii) email address, (iii) compensation, (iv) job title, identification number, and affiliation with the Customer, (v) if you are an independent contractor, the name of your employer, (vi) a photo of you, and (vii) reimbursable expenses that you incur. In addition to using this information to provide our Services to the Customer, we may use your email address to email you about your account, your use of the Platform, and promotional offers relating to the Platform.
Automatically Collected Information.
Browser & Device Information. Whenever you interact with the Services, we automatically receive and record information on our server logs from your browser or device, which may include your IP address, geolocation data, device identification, “cookie” and pixel tag information, the type of device you’re using to access the Services, the amount of time spent on the Services, and the page or feature you requested. “Cookies” are identifiers we transfer to your browser or device that allow us to recognize your browser or device and tell us how and when pages and features in the Services are visited and by how many people. “Pixel tags” are tiny graphic images with a unique identifier, similar in function to cookies, that are used to track online movements of web users. In contrast to cookies, which are stored on a computer hard drive, pixel tags are embedded invisibly in web pages. You may be able to change the preferences on your browser or device to prevent or limit your device’s acceptance of cookies and pixel tags, but this may prevent you from taking advantage of some of our features. We use the data we automatically collect from you to customize content for you and to improve the Services – for example, this data can tell us how often users use a particular feature of the Services, and we can use that knowledge to make the Services interesting to as many users as possible. In addition, this information can help us detect unusual activity on the Platform and take proper security measures.
Emails. We may receive a confirmation when you open an email from us.
DISCLOSURE OF INFORMATION. We may disclose your personal information to the categories of third parties identified in this section.
Personnel and Third Party Service Providers. We employ personnel and engage other companies and people to perform tasks on our behalf and need to share your personal information with them to provide products or services to you. For example, we use a third party cloud provider to host the data that we collect through the Platform.
Business Transfers. If we (or our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, personal information could be one of the assets transferred to or acquired by a third party.
Legal Compliance. We reserve the right to access, read, preserve, and disclose any information that we believe is necessary to comply with governmental requests, law enforcement or court orders, or enforce or apply the Customer Agreement.
SECURITY. We use commercially reasonable physical, administrative, and technical safeguards to preserve the integrity and security of your personal information. In addition, we enter into contracts with all of our third party service providers that require reasonable precautions be taken against unauthorized uses of your personal information. We cannot, however, ensure or warrant that these precautions will always be successful or that your personal information on the Services may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, administrative, or technical safeguards. We are not responsible to our users or to any third party due to any such loss, misuse, or alteration.
MODIFICATION, DELETION & RETENTION OF INFORMATION. Through your account settings, you may access, edit and delete the information identified in Section 1 (“Your Submitted Information”). Please understand, however, that it may be impossible to delete Your Submitted Information completely, due to backups and records of deletions. In addition, we may deny a deletion request if (i) the denial is necessary for us to comply with applicable law, or (ii) the request pertains to information that was submitted by the Customer and that cannot be deleted without impacting the Services for the Customer or your Coworkers. You may not request the removal of de-identified, anonymous, or aggregate data from our databases.

Subject to your right to request deletion of your personal information, we will retain your personal information as long as needed for your and the Customer’s use of the Services, your approved receipt of communications from us, our compliance with legal obligations, and to protect our or other’s interests.HOW WE RESPOND TO DO NOT TRACK SIGNALS. We do not track you or collect your information across third party websites or online services. Thus, we do not receive Do-Not-Track signals, or other similar signals. To the extent that we do receive any such signals, we will not comply with them as it is not an aspect of the functionality of the Services.
AGE OF USERS. Children under the age of 13 are not permitted to use, access or register for the Platform in any way. We do not knowingly collect or solicit information from anyone under the age of 13. If we learn that we have collected personal information from a child under the age of 13, we will delete that information as quickly as possible.
CHANGES TO POLICY. We’re constantly trying to improve the Services, so we may need to change this Policy from time to time as well. The date of the last modification will be posted at the beginning of this Policy. It is your responsibility to check from time to time for updates. By continuing to access or use the Services, you are indicating that you agree to be bound by the modified Policy.
